Pennsylvania dog laws are clear about dog owners’ responsibilities to protect people from being attacked, bitten, or harmed by their dogs. Pennsylvania does not allow “Breed Specific Laws” to be adopted to ban or regulate specific dog breeds. In Pennsylvania, until a dog attacks it is not considered dangerous. Dogs that attack humans or other animals can be returned to their owners with just a warning to owners to keep their dogs “under control.” Pennsylvania also has a three-strike policy that allows the dog’s return after two incidents unless a dog kills or seriously injures a person. It is only after a third “non-serious” mauling that it becomes mandatory an aggressive or dangerous dog be euthanized.
On January 10, 2010, a 22-year-old woman, Danielle Leven, was attacked and severely mauled by a friend’s pit bull. The unprovoked attack took place on the dog owner’s property and according to the Montgomery News, “Lansdale Police Sgt. Alex Kromdyk said nothing criminal occurred. He said one needs to show culpability in a negligent, reckless, knowing or intentional matter for a criminal charge.” Sgt. Kromdyk further stated, “There’s no culpability here.”
